Payment Terms

1 – General Terms
These payment terms constitute a legal agreement between you (the "user") and APPLICATION MOBILE FIND INC. ("FIND" or "us"). By using the application, you agree to be bound by these terms.
You must be at least 18 years old to use FIND's paid features.
By accepting these Payment Terms, if you are a commercial enterprise, you declare that:
- You are duly authorized to conduct business in the country or countries in which you operate
- Your employees, officers, or representatives accessing payment services are duly authorized to bind you under these terms
- Your use must be conducted solely or primarily for commercial or professional purposes, and not for personal, family, or domestic purposes
When you make payments or store a payment instrument, you agree that we may communicate with you electronically regarding important information related to your transactions or account.
2 – Making a Payment
2.1 Payment Transactions
When you make a payment or store a payment instrument via FIND, you agree to comply with these terms and to provide a valid payment instrument. You will need to add your payment instrument to your account in order to display job or service offer listings. Payment instruments may be credit or debit cards.
2.2 Pricing
The total price includes the listing fee and applicable taxes. You must provide accurate and complete information for tax and compliance purposes.
2.3 Disclaimer of Warranties
UNLESS OTHERWISE STATED IN WRITING BY US, WE PROVIDE NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING SERVICES PROVIDED OR SOLD THROUGH FIND, NOR ANY WARRANTY REGARDING THE REACH OF YOUR LISTING OR THE NUMBER OF RESPONSES YOU WILL RECEIVE.
2.4 Your Authorization
When you complete a transaction or provide a payment instrument, you confirm that you have the necessary authorizations to use that payment instrument. You authorize us to charge the amount using the payment instrument you use for the transaction.
2.5 Pre-Authorization Hold
If you pay by credit or debit card, we may obtain a pre-authorization from the card issuer for an amount up to the total price of your payment. This authorization may appear as a "hold" on your card.
- Failed payments: If your transaction results in overdraft fees or exceeds your credit limit, your card issuer may charge you fees for which you are solely responsible.
- Incompatibility: You may encounter a feature that does not support your preferred payment method. You may select another type of payment instrument.
- Security: We may delay or limit the availability of your purchase for security reasons or to ensure we have the information needed to process the payment.
3 – Actions We May Take
We may revoke your eligibility to make payments at any time and at our sole discretion, particularly if you have committed a material breach of these Payment Terms.
- Investigations: By using FIND's paid features, you agree that we may request information deemed necessary, directly or through third parties, regarding your identity and creditworthiness.
- Our right to cancel: We reserve the right to cancel transactions that appear to violate these Payment Terms or that could result in financial loss.
- Payment limits: In the face of a risk of financial loss, we may delay payments, limit payment instruments for a transaction, or disable your account.
- Information sharing: To avoid financial loss, we may contact your payment instrument issuer, authorities, or relevant third parties, and share details of any payment associated with you.
4 – Disputes and Cancellation
Support: You may contact us by email for any payment-related assistance.
4.1 No Liability for Third-Party Transactions
FIND does not allow you to make payments to third parties through its platform. We therefore cannot be held responsible for transactions you conduct with a user initially contacted via FIND. Our sole responsibility is to process your payment transaction to display a listing. All payments are final, unless otherwise required by law.
4.2 Fraud Warning
Using paid listings to conduct fraudulent actions or transactions may result in the loss of funds with no recourse.
4.3 Notification Duty
If you believe your account has been subject to an unauthorized or problematic transaction, you agree to notify us immediately. If you do not file your claim within 30 days of the charge being issued, you waive, to the extent permitted by law, any claim against us arising directly or indirectly from the transaction.
4.4 Technical Difficulties
In the event of a technical problem or service interruption causing your payment to fail, you may request that your transaction be rescheduled.
5 – Notices and Amendments to Payment Terms
5.1 Notice to You
By using FIND's paid features, you agree that we may communicate with you electronically regarding any important information about your payments or account. All notices are considered received within 24 hours of publication or sending. Notices sent by postal mail will be considered received within three (3) business days of sending.
5.2 Notice to Us
Unless otherwise specified, you must send all payment-related notices to us by email at: contact@findapp.ca
5.3 Amendment Terms
We reserve the right to modify these Payment Terms at any time, without notice, at our discretion, to the extent permitted by law. The Payment Terms in effect at the time a transaction is confirmed govern that transaction.
